Title: Environmental Law in South Africa Author: Jan Glazewski Publisher: 2nd Edition - Lexisnexis Butterworths ISBN No.: 040902937 Year of Publication: 2005 Website: http://www.lexisnexis.co.za
This work is a revision and update of the original version published in 2000, and takes the environmental law status right up to 31 March 2005.
The book includes views and perspectives on the new biodiversity legislation which is becoming a key part of “Triple Bottom Line” corporate and CSR policies. It also includes the expanded perspectives on protected areas which has taken traditional “nature reserves” thinking to a whole new plane. The date of publication means that the book has been able to include discussion on the NEMA Air Quality Act and the impending new EIA regulations.
There is much to cover in the way of topics and issues. However, it seems as though the author was forced to cut back on detail and expansion of many of the concepts and issues to prevent the book from becoming too unwieldy. For example, many of the mining issues are cut short and do not contain any in-depth case illustrations (other than case law) to explain some of the concepts and implementation perspectives.
One thing that disappoints me about this book is that it has not made use of, or consulted, the many corporate environmental professionals who have much to share on the practical application of, and compliance to, environmental law. Many of the case studies mentioned could really be enlightened if the perspective from the company side could be added to that of the activists’ and NGO point of view. It would also help to add more accurate data to illustrate impacts, positive and negative.
Recommended reference text for all environmental professionals, practitioners and managers who need an environmental law “where are we now” update.
